Welcome to gotta.blog, a blogging and newsletter platform operated by Jonah and Associates Pty Ltd (ABN 86 679 045 044), a company incorporated in Victoria, Australia.
These Terms of Service (“Terms”) are a legal agreement between you and Jonah and Associates Pty Ltd (“we,” “us,” or “our”). They govern your use of the gotta.blog platform, including all related websites, features, and services (the “Service”).
By creating an account, accessing, or using gotta.blog, you agree to be bound by these Terms. If you don't agree, please don't use the Service.
A few key terms used throughout:
- “Creator” — a person who registers a gotta.blog account to create and manage a blog, publish content, send newsletters, or monetise content through paid subscriptions.
- “Subscriber” or “Reader” — a person who visits a blog hosted on gotta.blog, subscribes to a creator's newsletter, or pays for premium content. Readers may or may not have a gotta.blog account.
- “Content” — any text, images, media, files, or other material that a Creator publishes or uploads through the Service.
- “Service” — the gotta.blog platform, including the website at https://gotta.blog, all creator blog sites hosted on our infrastructure, the editor, AI features, newsletter tools, analytics, and any related applications.
These Terms should be read alongside our Privacy Policy, which explains how we collect and handle personal information.
Eligibility
You must be at least 16 years old to use gotta.blog. If you are between 16 and 18, you may only use the Service with the consent of a parent or legal guardian, and that parent or guardian must agree to these Terms on your behalf.
By using gotta.blog, you represent that you have the legal capacity to enter into a binding agreement in your jurisdiction.
Account Registration and Security
To use gotta.blog as a Creator, you need to create an account. When you do:
- You must provide accurate, current information during registration.
- You are responsible for maintaining the security of your account credentials. Don't share your password with anyone.
- Each account is for a single person. Don't create multiple accounts to circumvent limits or bans.
- You must notify us promptly at contact@gotta.blog if you suspect any unauthorised access to your account.
We are not liable for any loss or damage arising from your failure to protect your account credentials.
The Service
gotta.blog provides a platform for creating, publishing, and distributing blog content and email newsletters. The Service includes blog hosting on custom domains, a rich text editor, AI-powered content tools, email newsletter delivery, analytics, paid content monetisation through Stripe Connect, and content import from other platforms.
We are always working to improve gotta.blog. This means we may add, change, or remove features at any time. We'll make reasonable efforts to notify you of significant changes, but we don't guarantee that any particular feature will always be available.
We use commercially reasonable efforts to keep the Service available and performing well. However, we do not guarantee uninterrupted or error-free operation. Downtime may occur for maintenance, updates, or reasons beyond our control.
Subscription Plans and Payment
gotta.blog offers a Free tier and a Paid tier. The Free tier provides limited access to features. The Paid tier unlocks the full platform experience. For current feature details, see our pricing page.
Paid subscription
The Paid tier costs $36 per year (USD), billed annually. Your subscription renews automatically at the end of each annual billing period. We will send you a reminder before each renewal.
You can cancel your subscription at any time from your account settings. If you cancel, you'll retain access to paid features until the end of your current billing period.
Refunds
We offer a full refund within 30 days of your initial purchase or renewal. After 30 days, no refunds are available. To request a refund, contact us at contact@gotta.blog.
Transaction fees for paid content
If you use Stripe Connect to accept paid subscriptions from your readers, gotta.blog charges a 5% platform fee on each transaction. This is in addition to Stripe's own processing fees (approximately 2.9% + $0.30 per transaction). Stripe handles all payment processing, card storage, and PCI compliance.
Creator tax obligations
If you earn revenue through paid subscriptions on gotta.blog, you are solely responsible for reporting and paying any applicable taxes. We are not your tax adviser.
Pricing changes
We may change our pricing with at least 30 days' notice to existing paid subscribers. The new pricing will take effect at your next renewal. If you don't agree to the new pricing, you can cancel before your renewal date.
Payment processing
All payments are processed by Stripe. By subscribing to gotta.blog or setting up paid content, you agree to Stripe's Terms of Service and Privacy Policy. gotta.blog does not store your credit card or bank account details.
Creator Content and Intellectual Property
You own your content
gotta.blog does not claim ownership of any Content you create or publish on the Service. Your words, images, and creative work remain yours.
License you grant us
By publishing Content on gotta.blog, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, display, distribute, cache, and transmit your Content as necessary to operate the Service. This includes delivering your Content via CDN, sending it in email newsletters, indexing it for search, and processing it through AI features you have enabled (such as SEO optimisation).
This licence exists solely to enable us to provide the Service to you. It terminates when you remove your Content or delete your account, subject to reasonable caching and backup periods.
Your representations
You represent and warrant that you own or have the necessary rights and permissions to publish all Content you upload, and that your Content does not infringe any third party's intellectual property or other rights.
Data portability
You can export your Content at any time through your account settings. We believe your data belongs to you, and we will never hold it hostage.
AI Features and Automated Processing
gotta.blog includes AI-powered features such as SEO/AEO optimisation, content suggestions, and writing assistance tools. Here's what you should know:
Third-party AI providers
AI features are powered by third-party providers, including OpenAI, Anthropic, and OpenRouter. When you use an AI feature, the relevant content is sent to the selected provider for processing, subject to that provider's terms and privacy policy.
Your control
AI-generated outputs — such as suggested titles, meta descriptions, or structured data — are suggestions only. You have full editorial control and are responsible for reviewing and approving any AI-generated content before publishing.
No training on your content
gotta.blog does not use your Content to train AI models. Third-party AI providers have their own data use policies, which we encourage you to review. We select providers whose policies align with creator data protection, and we use API configurations that minimise data retention where available.
No accuracy guarantee
AI outputs may contain errors, inaccuracies, or inappropriate suggestions. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. You are solely responsible for what you publish.
Prohibited Content and Acceptable Use
gotta.blog is a platform for thoughtful, legitimate content creation. The following types of content and activities are prohibited:
- Illegal content or activities — anything that violates applicable laws in your jurisdiction or the jurisdiction of your readers.
- Adult or sexually explicit content — pornography, explicit sexual material, or content primarily intended for sexual gratification.
- Hate speech and harassment — content that promotes hatred, threatens, harasses, or incites violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Spam and deceptive marketing — affiliate farms, fake reviews, link schemes, clickbait designed to mislead, or bulk-generated low-quality content.
- Financial schemes — cryptocurrency schemes, pyramid schemes, multi-level marketing (MLM) promotions, or fraudulent financial products.
- Gambling — gambling content or gambling-related promotions.
- Pharmaceutical promotions — unlicensed medical advice, promotion of prescription drugs, or unregulated health products.
- Intellectual property infringement — content that violates copyright, trademark, or other intellectual property rights.
- Malware and security threats — malware distribution, phishing, exploits, or any attempt to compromise the security of the Service or its users.
- Impersonation — misrepresenting your identity or falsely claiming affiliation with a person or organisation.
- Search engine manipulation — keyword stuffing, cloaking, hidden text, or other techniques designed to manipulate search engine rankings.
We reserve the right to remove Content and suspend or terminate accounts that violate these rules. For severe or repeated violations, we may act without prior notice.
DMCA and Copyright
We respect intellectual property rights and expect our users to do the same.
Reporting copyright infringement
If you believe Content on gotta.blog infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you believe is infringed.
- Identification of the infringing material and its location on gotta.blog (a URL is helpful).
- Your contact information (name, address, email, phone number).
- A statement that you have a good faith belief that the use is not authorised by the copyright owner.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Counter-notification
If you believe your Content was removed in error, you may submit a counter-notification with your contact information, identification of the removed material, a statement under penalty of perjury that you believe the removal was a mistake, and your consent to the jurisdiction of a federal court in your district.
Repeat infringers
We will terminate the accounts of users who are repeat copyright infringers.
Content flagging
Readers can also flag content they believe violates these Terms using the reporting feature on any blog post. We review flagged content and take appropriate action, which may include content removal or account suspension.
Email Newsletters
gotta.blog includes integrated email newsletter functionality, delivered through our platform's email infrastructure.
Creator responsibilities
If you send newsletters through gotta.blog, you must comply with all applicable anti-spam laws, including the CAN-SPAM Act (US), the General Data Protection Regulation (EU), and the Spam Act 2003 (Australia). Specifically:
- Only send newsletters to people who have opted in to receive them.
- Do not purchase, rent, or harvest email lists.
- Do not send misleading or deceptive emails.
All newsletters sent through gotta.blog automatically include an unsubscribe link. Do not remove or obscure this link.
We may suspend your email sending privileges if we detect spam-like behaviour or receive a significant number of complaints.
Subscriber consent
By subscribing to a creator's newsletter on gotta.blog, readers consent to receiving email communications from that creator. Readers can unsubscribe at any time using the link included in every email.
Subscriber and Reader Terms
Newsletter subscriptions
When you subscribe to a creator's newsletter, you consent to receiving emails from that creator through our platform. You can unsubscribe at any time.
Paid content
When you pay for premium content on a creator's blog, you are entering a transaction with the creator, not with gotta.blog. We facilitate the transaction through Stripe Connect, but the creator is the seller. gotta.blog is the platform.
Payment disputes related to creator content are handled through Stripe's dispute resolution process. If you have a concern about a creator's content or conduct, you can flag it using the reporting feature on their blog.
Termination
You can leave at any time
You can delete your account and export your data at any time through your account settings. If you are on a paid plan, refunds are available per our refund policy (full refund within 30 days; no refunds after).
We may terminate your account
We may suspend or terminate your account if you violate these Terms. For serious or repeated violations, we may act immediately and without notice. We may also terminate accounts without cause by providing reasonable notice (at least 30 days).
What happens after termination
When your account is terminated:
- Your access to the Service is revoked.
- Your blog is taken offline.
- You have 30 days to export your data before it is permanently deleted.
- Your Stripe Connect account is disconnected from gotta.blog.
- Subscriber data associated with your blog is deleted along with your blog.
Survival
Sections relating to intellectual property, limitation of liability, indemnification, governing law, and any other provisions that by their nature should survive, will survive termination of these Terms.
Disclaimers and Limitation of Liability
“As is” disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not warrant the accuracy of any AI-generated content.
Limitation of liability
To the maximum extent permitted by law, Jonah and Associates Pty Ltd's total liability to you for any claims arising out of or related to these Terms or the Service is limited to the amount you paid to gotta.blog in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement. If the Australian Consumer Law applies to you, our liability for breach of a consumer guarantee is limited, to the extent permitted by law, to the re-supply of the services or the payment of the cost of having the services re-supplied.
Other jurisdictions
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In those jurisdictions, our liability is limited to the greatest extent permitted by applicable law.
Indemnification
If you are a Creator, you agree to indemnify, defend, and hold harmless Jonah and Associates Pty Ltd and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your Content, your use of the Service, or your violation of these Terms.
Governing Law and Disputes
These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
Before initiating any formal proceedings, we encourage you to contact us at contact@gotta.blog so we can try to resolve the matter informally. Please allow at least 30 days for informal resolution.
Nothing in these Terms limits your rights under the Australian Consumer Law or any other mandatory consumer protection law that applies to you.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notification in the Service at least 30 days before the changes take effect.
Your continued use of gotta.blog after the changes take effect constitutes acceptance of the updated Terms. If you don't agree to the changes, you should stop using the Service before they take effect.
We will always post the current version of these Terms at https://gotta.blog/terms with the “Last updated” date.
Miscellaneous
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jonah and Associates Pty Ltd regarding the Service.
No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any failure or delay in performing our obligations where that failure or delay results from causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labour disputes, government actions, or internet or telecommunications failures.
